2. ACKNOWLEDGEMENT OF RISK

I hereby acknowledge that participation in safaris, game drives, hiking, mountaineering, water sports, cultural tours, and other adventure activities organised by Mara Expeditions involves inherent, significant, and serious risks, including but not limited to:

  • Encounters with wild animals
  • Vehicle accidents on rough and uneven terrain
  • Injuries from hiking, climbing, or walking in remote wilderness areas
  • Extreme weather conditions, altitude sickness, and exposure
  • Tropical diseases and other health risks
  • Limited or delayed access to medical facilities
  • Boat rides, rafting, or swimming in natural waters
  • Delays or disruptions beyond the control of the company
  • Loss or theft of personal property

I fully understand and voluntarily accept all these risks on behalf of myself and my dependents.

3. ASSUMPTION OF RESPONSIBILITY
I confirm that I am physically and medically fit to participate in the safari.

I agree to:
• Follow all safety instructions given by guides and staff
• Act responsibly and not endanger myself or others
• Inform Mara Expeditions of any medical conditions in advance

4. LIMITATION OF LIABILITY
To the fullest extent permitted by law, I agree that Mara Expeditions, its owners, employees, guides, and affiliates shall not be held liable for:
• Any injury, illness, loss, or damage to person or property
• Delays, cancellations, or changes caused by weather, mechanical issues, or third parties
• Loss or theft of personal belongings

5. RELEASE AND INDEMNITY
I agree to indemnify and hold harmless Mara Expeditions from any claims, damages, liabilities, or expenses arising from:
• My participation in the safari
• My failure to follow instructions or safety guidelines
• Any actions caused by my negligence

In consideration of being allowed to participate in the activities, I hereby irrevocably and unconditionally:
(a) Release and discharge Mara Expeditions, its directors, employees, guides, agents, contractors, and partners from any and all liability for any injury, illness, death, loss, or damage suffered by me.
(b) Indemnify and hold harmless Mara Expeditions against any claims, demands, costs, or legal actions arising from my participation.
(c) Waive any right to sue or claim compensation from Mara Expeditions, whether due to negligence or otherwise.
This release shall be binding on my heirs, executors, administrators, and assigns.

6. MEDICAL CONSENT
I confirm that I am in good physical and mental health and have no medical condition that may be aggravated by these activities. I have disclosed all relevant medical information below:

In the event of an emergency, I authorise Mara Expeditions to arrange medical treatment on my behalf. I agree to bear all associated costs.

7. INSURANCE
I understand that travel insurance is not included and is strongly recommended. I accept full responsibility for obtaining adequate coverage.

8. MEDIA CONSENT
I grant Mara Expeditions permission to use photographs or videos taken during the safari for marketing purposes unless I state otherwise in writing.

9. GOVERNING LAW
This agreement shall be governed by and interpreted in accordance with the laws of the Republic of Kenya.

10. DECLARATION
